  • Contains illegal content, including but not limited to the disclosure of insider information under securities law or another party’s trade secrets.
  • Consists of information or content that you do not have the legal right to share under any applicable law, contractual obligation, or fiduciary duty.
  • Contains any information or content that is false, misleading, or deceptively inaccurate.
  • Violates the Intellectual Property Rights or privacy rights of any third party. "Intellectual Property Rights" refers to patent rights, copyright rights, mask work rights, moral rights, publicity rights, trademark rights, trade dress, service mark rights, goodwill, trade secret rights, and other intellectual property rights that may currently exist or arise in the future.

If you are a client submitting Job Advertisements, you also agree that such content must not include any personally identifiable information.

Disclaimer and Limitation of Liability

Opening Hires functions solely as a platform for distributing User Content and does not take responsibility for verifying the accuracy, legality, or completeness of the content. As a result, Opening Hires assumes no liability for any User Content. You accept that you may encounter content that could be inaccurate, misleading, unlawful, offensive, or inappropriate, and it is your responsibility to ensure its validity and legality. Relying on User Content is solely at your own risk. Nevertheless, while Opening Hires is under no obligation to monitor User Content, it reserves the right to reject, remove, or suspend any User Content or account that violates this Agreement, any applicable laws or regulations, or poses a risk of harm or liability to Opening Hires.

Acknowledgment of Risk in User Interactions

You referred to as "You," acknowledge and agree that Opening Hires is not designed to authenticate or verify the identity of Users. The platform holds no responsibility for confirming the legitimacy of Users. Therefore, it is your responsibility to conduct your own diligence before engaging with any Users, including but not limited to job seekers, employers, staffing agencies, and recruitment professionals.

You willingly accept all risks associated with interactions with any Users you meet on this platform. Should any disputes or issues arise with a User, you agree to pursue resolution directly with that User.

By accepting these terms, you release and indemnify Opening Hires, along with its affiliates, employees, directors, and agents, from any claims, liabilities, and damages, whether direct, indirect, known, unknown, suspected, or undisclosed, to the fullest extent allowed by law.

Disclosure of User Content and Related Information

Opening Hires reserves the right to share User Content and relevant information about the contributor of such content with third parties. This is applicable for the operation and delivery of our Services, enforcement of any agreements made with you, compliance with legal obligations, and responding to inquiries from governmental authorities.

Moreover, to protect Opening Hires’s interests as needed, we may reveal such information. To clarify, by agreeing to these terms, you acknowledge our authority to disclose your identity to a third party claiming that any User Content you shared is fraudulent, false, misleading, violates the law, infringes on their intellectual property rights, or breaches their privacy rights.

Limitation of Liability for Damages and External Links

Under no conditions shall Opening Hires, its partners, or any referenced third parties on the Website be held responsible for any form of damages, including but not limited to incidental, consequential, or lost profits, or damages from data loss or business disruption due to the Website’s use or unavailability.
